The firm acts as special counsel for the Town of Eagle, Colorado for water matters. Mary Elizabeth Geiger has worked for the Town of Eagle in this capacity for over ten years. The Town of Eagle wanted to construct a new water treatment plant to serve current customers and future growth. In order to do so the Town of Eagle had to pursue a water court case for the approval of changes of senior irrigation water rights to municipal purposes and approval of an augmentation plan to allow the new water treatment plant to operate. This water court application was met with substantial opposition from neighboring municipalities, larger front range water users who take water from the western slope, and the Colorado Water Conservation Board which has instream flow rights on Brush Creek through the Town. On behalf of the Town Garfield & Hecht, P.C. was able to successfully negotiate and settle with all the opposing parties and work with the water court to obtain a final decree to allow the Town to move forward with construction of its new water treatment plant.
